Terms of Service

1. Acceptance of Terms

By accessing or using the RezCasa platform ("Service"), operated by Rezcasa Hospitality Group, 111 W 17th St, New York, NY 10011 ("RezCasa", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. RezCasa reserves the right to modify these Terms at any time; continued use constitutes acceptance of the revised Terms.

2. Description of Service

RezCasa is a marketplace connecting clients seeking catering and private event services ("Clients") with chef-vetted restaurant kitchens ("Partners") in New York City and Westchester. RezCasa facilitates discovery, menu proposals, communication, payment processing, and event coordination but is not itself a caterer or venue operator. Posting a request is free, requires no credit card, and creates no commitment until you accept a menu and book.

3. Accounts & Eligibility

You must be at least 18 years old and provide accurate registration information. You are responsible for maintaining the security of your account credentials. RezCasa may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Booking & Payments

Payments are made by card and processed by Stripe. When you accept a menu and book, you are charged as follows:

• Catering orders: 100% of the booking total is charged at booking.
• Private events: a 50% deposit is charged at booking. The remaining 50% is charged automatically to the card saved at booking on the day of the event. If that charge fails, we notify you and retry daily for up to 7 days; please keep a valid card on file.
• Gratuity: you may add an optional gratuity (0%, 15%, 20%, or 25%) at checkout. Gratuity is paid in full to the Partner.
• Promo codes: a valid promo code reduces the price charged at booking. The discount is funded half by RezCasa and half by the Partner; the Partner's payout reflects its half.
• Platform fee: RezCasa deducts a 7% platform fee from the amount paid out to the Partner. Clients are not charged a separate platform fee.

Payment protection. Funds you pay are held by RezCasa in its Stripe account until the event is delivered. This is not a third-party escrow service. Funds are released to the Partner 48 hours after you confirm delivery, or automatically about four days after the event if you have neither confirmed delivery nor reported an issue. An open dispute pauses release until it is resolved.

Partner subscriptions. Partners subscribe to a Pro ($149/month) or Elite ($249/month) plan in addition to the 7% platform fee on each booking. Partners admitted to the Founding Partner Program (Section 6) are exempt from the subscription for 12 months from approval; the 7% platform fee still applies. Partner payouts are made through Stripe Connect 48 hours after delivery is confirmed.

5. Cancellation & Refund Policy

Clients may cancel a confirmed booking at any time. Refunds are calculated based on the time remaining until the event:

• More than 72 hours before the event: 100% refund
• 24 to 72 hours before the event: 75% refund
• Less than 24 hours before the event: 50% refund

Refunds are returned to the original card. If a refund cannot be processed automatically, we notify you and the RezCasa team resolves it directly.

6. Partner Obligations

Partners agree to maintain valid health certifications, accurate menu information (including allergen tags), and timely communication with Clients. RezCasa reserves the right to remove Partners who fail to meet its quality standards.

Founding Partner Program

RezCasa may admit a limited number of Partners to its Founding Partner Program ("Founding Partners"). Admission is at RezCasa's sole discretion and is limited to 20 kitchens.

• Subscription waiver: a Founding Partner's Pro or Elite subscription fee is waived for 12 months from the date RezCasa approves the Partner. The 7% platform fee on each booking still applies and is deducted from the Partner's payout.
• Badge: Founding Partners may display a "Founding Partner" badge on their public listing and in their dashboard for as long as their status is in effect.
• Commitments: each Founding Partner commits to four things: (1) menus with real, current prices; (2) reply to every request within one business day; (3) honor every quote you send; (4) keep your Stripe account connected so payouts work.
• Revocation: RezCasa may revoke Founding Partner status if a Partner breaches any of these commitments or these Terms. On revocation, the subscription waiver and badge end.
• Conversion: when the 12-month waiver ends, the Partner converts automatically to the Pro plan at the then-current published rate (currently $149/month). RezCasa will give at least 30 days' notice before the first subscription charge.
• No cash value: Founding Partner status and the subscription waiver have no cash value, cannot be redeemed for cash or credit, and are non-transferable.

7. Intellectual Property

All content on the RezCasa platform, including logos, designs, text, and software, is the property of RezCasa or its licensors. You may not copy, modify, or distribute any platform content without written permission.

8. Limitation of Liability

RezCasa acts as a marketplace facilitator. We are not liable for the quality, safety, or legality of services provided by Partners. In no event shall RezCasa's total liability exceed the amounts you paid through the Service for the booking(s) giving rise to the claim in the 12 months preceding the claim.

9. Dispute Resolution

Any disputes between Clients and Partners should first be reported through the platform's dispute resolution system. If unresolved, disputes shall be settled by binding arbitration in New York County, NY, under the rules of the American Arbitration Association.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions.
